Terms & Conditions

This Contract is governed by the laws of the State of Florida, including the Florida Home Solicitation Sales Act (Fla. Stat. §501.021). Any provision found invalid shall not affect the remaining provisions of this Contract.

1. Equipment Ownership

Title to the equipment and all components shall remain the legal property of Water Energy Solutions LLC until the equipment is paid in full. The Purchaser(s) acknowledge giving a security interest in the merchandise purchased. No part of this Contract shall be altered, modified, or varied in any manner except in writing and approved by Water Energy Solutions LLC management.

2. Limitation of Liability

Water Energy Solutions LLC agrees to diligently work to complete installation but shall not be responsible for delays caused by: funding of loans, acts of negligence or omissions of the Purchaser(s), acts of God, stormy weather, extra work ordered by Purchaser(s), acts of public enemies, civil unrest, or causes beyond Water Energy Solutions LLC control. The obligations of Water Energy Solutions LLC are limited exclusively to repair or replacement of the product at the sole discretion of Water Energy Solutions LLC. Under no circumstances shall Water Energy Solutions LLC be liable for consequential, incidental damages, or losses of any kind.

3. Property Access

The Purchaser guarantees full access to the property for Water Energy Solutions LLC technicians and installers for installation, service, and/or removal of the equipment. Water Energy Solutions LLC workers shall not be responsible for keeping gates closed for animals and children. Purchaser is responsible for ensuring safe access conditions.

4. Financing

Financing is subject to approval and verification by an external financial institution. Water Energy Solutions LLC is not a lender and assumes no responsibility for financing terms, approvals, or conditions. In the event that Purchaser(s) are denied credit from Water Energy Solutions LLC's primary financing source, Purchaser(s) agree to sign substitute financing contracts upon demand from any other financial institution, including but not limited to Security Agreements, Lien Contracts, or Assignment of Rents Contracts.

5. Binding Arbitration

Any dispute, claim, or controversy arising out of or related to this Contract shall be resolved exclusively through binding arbitration in accordance with the rules of the American Arbitration Association (AAA). Jurisdiction and venue shall be Hillsborough County, State of Florida. The arbitrator's decision may be registered in any court with jurisdiction.

6. Attorney's Fees

In the event of any legal dispute, the prevailing party shall be entitled to recover reasonable attorney's fees and court costs from the non-prevailing party.

7. Governing Law

This Contract shall be construed and governed exclusively by the laws of the State of Florida. If any provision is found invalid for any reason, such invalidity shall be confined to the requirements of applicable law and shall not affect the remainder of this Contract, which shall continue in full force and effect.

8. Entire Agreement

There are no written or verbal agreements outside of this Contract. No representations, promises, or agreements, oral or otherwise, have been made with reference to this sale except as expressly stated herein. If not in writing and approved by Water Energy Solutions LLC management, it shall not be recognized.

Notice of Cancellation

If you cancel: Any property traded in, any payments made by you, and any negotiable instrument executed by you will be returned within TEN (10) business days following receipt by the seller of your cancellation notice. You must make available to the seller, in substantially as good condition as received, any goods delivered to you. If the seller does not pick up the goods within Twenty (20) days of this notice, you may retain them without further obligation.
